Digital Millennium Copyright Act

It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (the text of which can be found at the U.S. Copyright Office Web Site, (http://www.copyright.gov/) and other applicable intellectual property laws, which may include removing or disabling access to material claimed to be the subject of infringing activity. If you believe that your copyrighted work has been copied and is accessible on one of our hosted sites in a way that constitutes copyright infringement, please follow the procedures that we have specify below. If we remove or disable access to comply with the Digital Millennium Copyright Act, we will make a good-faith attempt to contact the owner or administrator of each affected site so that they may make a counter notification pursuant to sections 512(g)(2) and (3) of that Act.

CAUTION: Pursuant to Title 17, Section 512(f) of the United States Code, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

Procedure for Making Claims of Copyright Infringement:

All infringement claims must meet the following requirements:

• It must be a written communication (by regular mail or fax);
• It must be sent to the designated agent identified below;
• It must include the following:
  
  1. A physical or electronic signature of the Person making claims of copyright infringement.
  2. A description of the copyrighted work that you claim has been infringed and a description of the infringing activity.
  3. Identification of the location where the original or an authorized copy of the copyrighted work exists, for example the URL of the website where it is posted or the name of the book in which it has been published. You must include enough information to allow us to locate the material.
  4. Your name, address, telephone number, and email address.
  5. Include the following statement: "I have a good faith belief that use of the copyrighted materials described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law."
  6. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Procedure for Making Counter Notification:

All Counter Notification must meet the following requirements:

• It must be a written communication (by regular mail or fax);
• It must be sent to the designated agent identified below;
• It must include the following:
  1. A physical or electronic signature of the person submitting the counter notification.
  2. A description of the copyrighted work that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement, under penalty of perjury, that you have good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. Your name, address, telephone number, and email address.
  5. Include the following statement: "I have a good faith belief that use of the copyrighted materials described above on the allegedly infringing web pages is authorized by the copyright owner, its agent, or the law."
  6. Include the following statement: "I swear, under penalty of perjury, that the information in this counter notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
