Billing Policy

Payment

You will pay all charges for the first month of service in advance on the first day of the Initial Term. You will pay all subsequent charges for Services in advance on the anniversary day of each month according to the then current price for the Services. You must pay for the Services by credit card. You authorize HOSTLANTIC to charge your credit or debit card to pay for any charges that may apply to your account. You must notify HOSTLANTIC of any changes to your card account (including, applicable account number or cancellation or expiration of the account), your billing address, or any information that may prohibit HOSTLANTIC from charging your account. Your failure to fully pay any fees and taxes within 72 hours from the applicable due date is a material breach of this Agreement, justifying HOSTLANTIC to suspend its performance and terminate this Agreement. If HOSTLANTIC terminates your account for material breach, you will be required to pay immediately all fees and costs accrued before the termination date, all monthly recurring fees for each month remaining in the term and any other amounts you owe to HOSTLANTIC under this Agreement. You are responsible for any costs HOSTLANTIC incurs in enforcing collection, including reasonable attorneys' fees, court costs and collection agency fees. To reinstate Services, you must pay for 3 months of Service in advance on the first day such Services are reinstated and any fees associated with reinstating Services.


  • Renewal

    If not canceled by CUSTOMER, this Agreement will automatically self-renew after each billing period for an additional billing period. CUSTOMER'S failure to properly notify HOSTLANTIC of its objections to any of the terms and conditions set forth herein shall constitute CUSTOMER'S acceptance of same agreement. This Agreement shall automatically renew itself for an additional billing period unless otherwise canceled or terminated by either party in accordance with the notice provision set forth herein. In the event this Agreement is automatically renewed, CUSTOMER agrees to be bound by the Terms and Conditions currently in effect.


  • Delinquent Accounts

    1. If you elect to have us automatically charge your credit card, we will do so approximately 21 days after we send your monthly statement. We will keep your recurring credit card authorization on file until we receive written or explicit instructions from you indicating otherwise.
    2. If you fail to pay your bill within 30 days, we will assess a monthly late payment fee of 1.5% or $5.00, whichever is greater. This fee is considered liquidated damages, and is not a penalty.
    3. If you fail to pay your bill within 60 days, we will assess an additional late payment fee, and we will suspend your account. We will not reactivate a suspended account until we receive payment in full, at which time it will be subject to a $10.00 account reactivation fee. Although we may suspend your account, you are not eligible for a pro-rated refund for the time that your account was suspended.
    4. If you fail to pay your bill within 90 days, we will terminate your account, at which time all files, emails, settings, and configuration will be deleted.

  • Refund and Disputes

    1. All payments to HOSTLANTIC are nonrefundable. This includes any applicable setup fees and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 60 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in HOSTLANTIC 's sole discretion is a valid charge under the provisions of this Agreement, you agree to pay HOSTLANTIC a "Dispute Review Fees" of $100.00.
    2. Our 45-day money back guarantee applies to all Web Hosting (Windows and Cold Fusion) and Ecommerce Web Hosting plans. If you are dissatisfied with our service for any reason, you will receive a full refund on the hosting fee if you cancel your account within 45 days of the activation of your account.
    3. Our refund policy does not apply to any additional items or services; this includes but is not limited to POP accounts, Real Audio®/Video® and MySQL. Also not included are Account Renewals, Domain Parking services, Domain Registration and Dedicated services, as well as Reseller programs. Please be aware that there are no pro-rated refunds after the first 45 days of service and absolutely no refunds are available after 45 days.
    4. In order to cancel any service, all customers must submit a ticket to the Billing department. Your request will be processed and you will receive a confirmation number within 3 business days. Please allow 4-6 weeks for refunds of check or money order payments. Additional processing fees apply for T/T refunds.
    5. Accounts cancelled/terminated by Hostlantic for violating our Terms of Service do not qualify for the 45-day money back guarantee. For example, if your account is cancelled due to spamming, you will not be given any refund. However, the $7.95 Domain Name registration fee is not refundable. It is registered for one year under your name. However, should you decide to discontinue your service, we would be more than happy to assist you in transferring the domain name if you choose to do so.

  • Term; Termination; Cancellation Policy

    1. The initial term of this Terms of Services shall be as set forth in the Order Form. The Initial Term shall begin upon commencement of the Services to Customer. After the Initial Term, this TOS shall automatically renew. ADDITIONALLY AFTER THE INITIAL TERM, YOU ACKNOWLEDGE, AGREE AND AUTHORIZE HOSTLANTIC AUTOMATICALLY BILL AND/OR CHARGE ON YOUR CREDIT CARD FOR SUCCESSIVE TERMS OF EQUAL LENGTH AS THE INITIAL TERM, UNLESS TERMINATED OR CANCELLED BY EITHER PARTY AS PROVIDED IN THIS SECTION. The Initial Term and all successive renewal periods shall be referred to, collectively, as the "Term".
    2. This Agreement may be terminated by either party by giving the other party thirty (30) days prior written notice, by HOSTLANTIC in the event of nonpayment by Customer; by HOSTLANTIC, at any time, without notice, if, in HOSTLANTIC's sole and absolute discretion and/or judgment, Customer is in violation of any term or condition of this Agreement and related agreements or, in HOSTLANTIC's sole and absolute discretion and/or judgment, could disrupt, HOSTLANTIC's business operations.
    3. To schedule your account for cancellation, please login to your account and fill out the information as indicated. This will ensure that your account is processed for cancellation and will generate an email that will be sent to as soon as possible regarding full details of your request as well as the offline date of your server. We cannot be held responsible for continued invoicing if the above method is not followed. If you cancel this agreement, upon proper notice to HOSTLANTIC, prior to the end of the Initial Term or any Term thereafter, you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation; HOSTLANTIC may refund to you all pre-paid fees for basic hosting services for the full months remaining after effectiveness of cancellation (i.e., no partial month fees shall be refunded), less any setup fees and any discount applied for prepayment, provided that, you are not in breach of any terms and conditions of this TOS, Spamming Policy or Domain Policy; and/or you shall be obligated to pay 100% of all charges for all Services for each month remaining in the Term (other than basic hosting fees). Any cancellation request shall be effective thirty (30) days after receipt by HOSTLANTIC, unless a later date is specified in such request.
    4. HOSTLANTIC may terminate this Agreement, without penalty, if the Services are prohibited by applicable law, or become impractical or unfeasible for any technical, legal or regulatory reason, by giving Customer as much prior notice as reasonably practicable; or immediately, if HOSTLANTIC determines in good faith that Customer's use of the Services, the Web site or the Customer Content violates any HOSTLANTIC term or condition, including this TOS, Spamming Policy, or Domain Policy. If HOSTLANTIC cancels this Agreement prior to the end of the Term for your breach of this Agreement and related agreements, including the HOSTLANTIC, Spamming Policy, or Domain Policy or Customer's use of the Services disrupts our network, HOSTLANTIC shall not refund to you any fees paid in advance of such cancellation and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation; further, you shall be obligated to pay 100% of all charges for all Services for each month remaining in the Term and HOSTLANTIC shall have the right to charge you an administrative fee of $50.00.
    5. Upon termination of this Agreement for any cause or reason whatsoever, neither party shall have any further rights or obligations under this Agreement, except as expressly set forth herein. Termination of this Agreement and retention of pre-paid fees and charges shall be in addition to, and not be in lieu of, any other legal or equitable rights or remedies to which HOSTLANTIC may be entitled.
